Hindemith Organ Concerto 1964 schott

Just want to be clear on this. I likely know this but just want to be sure. This piece, the organ concerto I got ahold of a copy recently has the publishing date from 1964 from Schott but the interesting thing is that Hindemith wrote the piece in 1962-63, had a first performance in the US in New York in April 1963 but Hindemith died in december of the same year but the piece was published in 1964, which I know is less than 50 year from the end of the calander year currently for Canada. Would this piece then be PD because of the performance or NonPD currently because of the publication until the end of this year? If I could upload it now, could the admins then block it until January 2015 then to open it to the public?

According to the Canadian law, performance in public is equivalent to publication. So, publication of the score in 1964 makes no difference.

Max is correct. The hard cases for Canada (and only for composers who died after 1947) are those were the piece was really never even performed until less than 50 years ago, like Webern's Langsammer Satz.

Yes, you can. Given the information you kindly provided, I'm pretty sure that copyright reviewers will approve and tag it as public domain in Canada only, so that it will be automatically made available through the PML-CA server.

This piece was premiered by the New York Philharmonic on April 25, 1963 with soloist Anton Heiller. So as Carolus and Max have mentioned, once you upload this piece, provided it isn't edited or "contributed" by anyone other than Hindemith, it will be marked as public domain for Canada.
