In this case, the claim won't even work (as they claim on violation of editio princeps rule) if there's really published copies circulated at prior. (Performance doesn't count in Germany's law; that's for Canada) Would you mind to provide evidence of such published copies in 18th century exists?

Then it would fall into the "fixed form" scenario as you used his recording with his "creative" interpretation, which makes it copyrightable with the performer virtually everywhere (albeit in this case the copyright is expired in Canada).

I think I could answer this question. You said that you has "Based on the playing of Clarence Ashley" right? Then how do you know if Ashley has NOT arranged the work in his performance? Notated or not is not the criteria for that. Since you said "Based on" someone's performance, ...

I understand, but there's some deadlines catching up, and I'm yet to compile all my stuff into pdfs
