Re: DIAMM and IMSLP

noqu,

Thanks for the suggestion!

I think it's a good starting point as well. Making lower-quality (but still legible) files of the MSS up there available on IMSLP may be a great way to move forward.

Cheers!

Re: DIAMM and IMSLP

Thank you Carolus, The "gatekeepers," as you call them, are painfully aware that the custody of a physical object is distinct from the ownership of the intellectual property. But they have to take care of the object, and don't have the luxury (like IMSLP) of housing an entire library on a ...

Re: DIAMM and IMSLP

imslp said: This is also what makes our role as guardians of the public domain even more important. The more I think about this statement, the more I think that this is a pretty awful statement to make. It's like you think you're alone in this fight. You are not the guardians of the public domain. Y...

Re: DIAMM and IMSLP

That is undoubtedly true of a private library which receives no public funding whatsoever. However, once you start receiving payment from public funds - collected via taxes, this equation starts to change. No, it doesn't change anything. Have you ever tried to photograph a manuscript? Even a librar...

Re: DIAMM and IMSLP

That's assuming you can even see it to photograph it. All the rights in the world won't help you get past a locked door. If you try you'll quickly find that any reliance on arguments of public domain access will be trumped by violation of property rights.

Re: DIAMM and IMSLP

I thought I would share a Facebook post from the Musikwissenschaft Universität Mainz regarding this, just so their voice is heard as well. The original in German is here: https://www.facebook.com/MusikwissenschaftUniMainz/posts/10151966492037914 The English translation is as follows: "Musikwiss...

Re: DIAMM and IMSLP

So you're willing to sacrifice the greater public good just because you want to be a machine? There is no slippery slope. I'm sorry, but you're not a machine. IMSLP is a bunch of people. It doesn't have a legal mandate to act as a copyright defender. It might see it as its core mission, but that's d...

Re: DIAMM and IMSLP

Melodia: And if you're late paying a bill because a member of your family is sick, why should XYZ Corporation make an exception for you when you call them and plead for a bit more time? It would be a sad state of affairs for IMSLP to be in the same league as Bell or British Telecom or AT&T, a fa...

Re: DIAMM and IMSLP

Notenschrieber: That sounds like a great idea to me!

I think a compromise for the moment might be for IMSLP to be a "dark archive" -- holding, but not distributing.

Would that be possible?

Re: DIAMM and IMSLP

As I understand it, the presence of PDFs on IMSLP means that publication-quality images are now distributed outside of DIAMM, and therefore libraries, who have negotiated to maintain their restriction on publication, have no way to centrally manage how and where these images get published. Some of t...

Re: DIAMM and IMSLP

Hey Feudol, thanks for joining the discussion! Fortunately for all of us, the law is not a binary set of rules. That's why we have judges that listen to arguments instead of machines that declare guilt or innocence. I'm sure you would be glad of that too, when you're on the other side of the argumen...

Re: DIAMM and IMSLP

Some libraries understand that their primary purpose to to make things available for access to anyone interested. Others appear to be stuck in a previous century - conflating the notion of property ownership with content ownership. Assuming that all libraries are institutions of access is a modern ...

Re: DIAMM and IMSLP

If Julia understands why I had to ban her and apologizes, she can be un-banned just as easily from the wiki also. She might have been panicked about this issue, which I can understand. Forgive me, but this comes off as bit patronizing. I don't want to derail the conversation into he said/she said, ...

Re: DIAMM and IMSLP

Thanks cypressdome. I'm not officially connected to them, but I have worked with them for a few years now. I imagine the reason you haven't heard from them is that they're trying to co-ordinate a response (they are an organization, so they don't really have the luxury of shooting off their mouth lik...

Re: DIAMM and IMSLP

Because of that, I can't find a single element in Andrew's arguments that is supportable. I'm curious, kosboot -- what part of my arguments can't you support? My argument is that DIAMM needs physical access to these sources, and with out the ability to partner with libraries, there can be no more h...
