Baerenreiter Frescobaldi and Gabrieli

Hi all,
i uploaded Frescobaldi and Gabrieli keyboard works published by Pierre Pidoux, Baerenreiter in '50, '60, '70es.
I saw they have been marked as Non-PD USA. Is the US copyright law on copyright renewal applicable also for works published in Germany? If this is the case all scientific editions published after 1923 are not PD in USA?

Hi Ctesibius,

I marked these according to the 95 year ruling in the US, since there is no body of law to suggest the US treats copyright terms differently for urtext works, unlike the country of origin (Germany) - and you'll find ample numbers of examples of this all over IMSLP. The only exceptions in terms of Bärenreiter appear to be a few scores (such as the Handel Water Music suites) where the copyright registration prior to 1963 was fouled up. Sorry about this, but the scores will become available when IMSLP's long-standing technical issue is resolved.

thanks for the reply.
Still I am a bit confused. from your email I understand all music published after 1923 is copyrighted in the independently where it was published . For instance the Toccatas published by Germani in 1951 on the same composer page (http://imslp.org/wiki/Toccate_e_Partite ... _Girolamo))
are fine. What the difference.

I have lot of keyboard music in similar copyright status (Breitkopf, Peters, Baerenreiter works of baroque composers published more than 25 years ago). Is it a problem if i publish them? (in the worst case they will be marked TB). Is the same applicable to the volumes of CEKM (american institute of musicology)?

I just returned from vacation, but will make a note to check the items you uploaded with the Masters Music catalog. Masters has reprinted a fair number of the Baerenreiter organ issues thanks to the original publisher's failure to comply with the notice and renewal formalities of US law. Because of the urtext nature of the editions, they would not have been eligible for restoration of copyright status under the GATT/TRIPs amendments to US law due to being public domain in their country of origin (Germany). It's possible that these are actually free in the USA.
